THE RESIDENTIAL EVICTION PROCESS
Depending on the type of issue you have, the packet of forms you select contains the following forms:
These forms are designed for use in common landlord/tenant disputes involving residential leases; if you have a commercial, agricultural or personal property lease, you should consult with an attorney. Other forms referred to in these instructions are available on the Leon County Clerk’s Office website, www.clerk.leon.fl.us, Online Services, Forms, Complete / Save / Print Forms, Court Forms, County Civil / Small Claims, or in the Clerk’s Help Center, located at 301 South Monroe Street, Suite 100, Tallahassee, FL 32301.
You should not complete any forms until you have carefully reviewed and understand the instructions preceding the forms. Whether you use our form or prepare your own, it is your responsibility to make sure all required information has been entered. Failure to submit completed forms could result in a delay in your case.
The residential landlord/tenant relationship is controlled by the terms of your lease and by Part II of Chapter 83 of the Florida Statutes. The procedures for enforcing your rights under your lease and Part II of Chapter 83 are set forth in Section 51.011, Florida Statutes. You should review these statutes carefully before starting any legal proceeding concerning a residential lease. The Florida Statutes are located at http://www.flsenate.gov/Statutes/.
